Terms of Service

1. Acceptance of Terms

By accessing or using the Tracius Traceability Hub platform ("Platform") or the tracius.com website ("Website"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform or Website.

2. Platform Description

Tracius Traceability Hub is a software-as-a-service (SaaS) platform for product serialization, traceability, and compliance management. The Platform captures, stores, and routes EPCIS 2.0 events for compliance with regulatory mandates including EU Digital Product Passport, GS1 Sunrise 2027, Amazon Transparency, and DSCSA.

3. Account and Access

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • Multi-factor authentication (MFA) is mandatory for all platform users
  • You must notify us immediately of any unauthorized access to your account

4. Subscription and Billing

  • Platform access is provided on a subscription basis (annual or monthly billing)
  • All prices are stated in EUR and exclude applicable taxes
  • Subscriptions renew automatically unless cancelled 30 days before renewal
  • Paid pilots are governed by separate pilot agreements

5. Data Ownership and Portability

You retain full ownership of your data. Tracius does not claim any intellectual property rights over your product data, EPCIS events, or serial number information. You may export your data in standard EPCIS 2.0 JSON-LD format at any time.

6. Service Level

  • Core platform: 99.9% uptime target
  • Consumer-facing pages: 99.95% uptime target
  • Scheduled maintenance windows will be communicated at least 48 hours in advance
  • Enterprise tier: dedicated SLA with defined response times

7. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Attempt to access data belonging to other tenants
  • Reverse-engineer, decompile, or disassemble the Platform
  • Exceed rate limits or abuse API endpoints
  • Share account credentials with unauthorized users

8. Intellectual Property

The Platform, Website, documentation, and Trust Package materials are the intellectual property of Tracius B.V. Your subscription grants you a non-exclusive, non-transferable license to use the Platform for your internal business purposes.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Tracius shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the fees paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate the subscription with 30 days' written notice before the next renewal date. Upon termination, you may export your data for 30 days. After that period, your data will be securely deleted.

11. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent courts in the Netherlands.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect.
